W2C Customs Management (“W2C”) is an authorized Canada Customs broker and acts as a professional agent on behalf of an importer or exporter in the preparation and presentation of all documents required for the clearance of goods imported into Canada. “W2C” has no intellectual or contractual rights to the software of the “GMX Worldwide Xpress” courier service provider site and does not operate the interaction between the shipper and the website provider and courier service providers.

Use of the courier service site “GMX Worldwide Xpress”

With the “GMX Worldwide Xpress” courier service provider site, “W2C” can directly connect customers who want to take advantage of low-cost shipping rates by facilitating quick access to competitive courier service providers in one place. By agreeing to use the courier service provider site, you agree to interact under the terms of the contract of carriage prescribed by the various courier service providers. Although “W2C” takes every care in the transmission and application of discounts on the website, we cannot be held responsible for the accuracy, completeness and timeliness of the information provided. In addition, “W2C” does not warrant that the website will operate without error or interruption, or that it is free of viruses. “W2C” expressly disclaims any liability for the accuracy, completeness, and timeliness of the information provided and the (uninterrupted) use of this website.

The “GMX Worldwide Xpress” website contains links to websites of reputable third-party mail service providers. “W2C” accepts no responsibility for the content, use or availability of third-party websites and the adverse consequences of using such links. W2C CUSTOMS MANAGEMENT AND THE W2C INTEGRATED COURIER SERVICE PLATFORM allows easy access to the COURIER SERVICE PROVIDER, hereinafter “GMX WORLDWIDE XPRESS, which provides transportation of documents and parcels on behalf of its customer, hereinafter “the sender”, through an international network in which “GMX WORLDWIDE XPRESS participates and at competitive rates.

The transport is governed by the present contract.

I. General Conditions

  1. The “shipper” accepts all the general conditions stipulated on www.W2C.com and certifies that all the information provided is correct and has been validated.
  2. If no service level is selected on a shipment order, “GMX WORLDWIDE XPRESS will route shipments sent within Canada and the United States with the “Next Day” service level. For international destinations, the “Express” service level will be applied.
  3. The goods described in this contract are accepted for carriage in apparent good condition, unless specifically indicated on the vessel order.
  4. To expedite transportation, “GMX WORLDWIDE XPRESS may substitute another carrier, including an inland carrier, without affecting the nature and conditions of this contract.
  5. “GMX WORLDWIDE XPRESS” does not accept passports, jewelry, tobacco, alcohol, art, glassware, perishables, traveler’s checks, cash/currency, or certain dangerous goods as part of this contract. Some items may be shipped at the sender’s risk.
  6. The sender must provide all relevant information on the contents and value of the shipment as may be required by any customs or other competent authority and will be responsible for any damage resulting from false, erroneous or contradictory statements.
  7. All duties and taxes on shipments will be charged to the recipient, unless the DTP option to reverse these charges is selected in Section 3 of the “GMX WORLDWIDE XPRESS site, at the time your shipment is made; duty and tax invoices are due upon receipt.

II. Delivery

Delivery times are directly linked to the carrier used and the service chosen. “GMX WORLDWIDE XPRESS” cannot guarantee delivery times. Refunds for service failure are not offered on discounted express services.

III. Limitation of liability

  1. If the shipment has a destination or stopover in a country other than the country of departure, the liability of “GMX WORLDWIDE XPRESS may be subject to the Warsaw Convention, which governs, and in most cases limits, the liability of the carrier for loss. The liability of “GMX WORLDWIDE XPRESS” shall in no case exceed the liability of the actual carrier.
  2. The liability of “GMX WORLDWIDE XPRESS” for loss of or physical damage to a shipment shall be limited to a maximum of one hundred Canadian dollars ($100.00) unless additional insurance has been purchased. This limit shall apply even in the event of fault or negligence on the part of “GMX WORLDWIDE XPRESS”.
  3. In the event of physical loss or damage to a shipment, “GMX WORLDWIDE XPRESS shall not be liable for loss of revenue or profits, whether “GMX WORLDWIDE XPRESShad knowledge of such damage. “GMX WORLDWIDE XPRESS will not be liable for your acts or omissions, including, but not limited to, improper declaration of cargo, improper or inadequate packing, securing, marking or addressing of the shipment, or acts or omissions of the consignee or any other person having an interest in the shipment. In addition, “GMX WORLDWIDE XPRESS” shall not be liable if the sender or receiver violates any of the terms of this agreement. “GMX WORLDWIDE XPRESS shall not be liable for any damage, loss, delay, shortage, misdelivery, non-delivery, misinformation or lack of information in connection with this shipment caused by events beyond the control of “GMX WORLDWIDE XPRESS including, but not limited to, acts of God, perils of the air, weather conditions, mechanical delays, acts of public enemies, war, strikes, civil disturbances or acts or omissions of public authorities (including customs and health officials) having actual or apparent authority.
  4. “GMX WORLDWIDE XPRESS” does not provide refunds for service failures if rates are reduced.
  5. “GMX WORLDWIDE XPRESSshall not be liable for any delay due to customs procedures or any other cause beyond the control of “GMX WORLDWIDE XPRESS or the carrier.

IV. Claims

In the event of damage, partial loss, delay, non-delivery or any other claim, the shipper must send a WRITTEN CLAIM to “GMX WORLDWIDE XPRESS” within seven (7) days of the date of delivery by “GMX WORLDWIDE XPRESS, except for domestic shipments where damage MUST be reported to “GMX WORLDWIDE XPRESS within 48 hours of delivery.

V. Right of Inspection

“GMX WORLDWIDE XPRESS, at its discretion or at the request of government authorities, may open and inspect any shipment under its control.

VI. Responsibility for payment

Even if the “shipper” gives “GMX WORLDWIDE XPRESS different payment instructions, the “shipper” will always be primarily responsible for all charges, including freight charges and all duties, customs assessments, governmental penalties and fines, taxes, legal fees, related to the shipment in the event of non-payment by the consignee or a third party. The “sender” shall also be responsible for any costs that “GMX WORLDWIDE XPRESS may incur in returning the shipment or storing it pending processing. Standard payment terms are 30 days.

Even if the sender is in default of payment, “GMX WORLDWIDE XPRESS reserves the right to invoice the receiver. Any freight forwarder, agent, partner, or logistics company that ships goods with “GMX WORLDWIDE XPRESS, and does not pay all shipping charges, “GMX WORLDWIDE XPRESSreserves the right to invoice the actual end shipper.

“Gmx worldwide xpress modalities”

Terms of service

  • Address correction: $15.00
  • No delivery to P.O. Boxes
  • “GMX WORLDWIDE XPRESSdoes not accept COD shipments.
  • Additional packaging (i.e., bubble wrap, peanuts, etc.) will be charged.
  • Non-box charge (non-corrugated packaging): $10.00
  • Delivery in residential areas (Canada and United States): $3.50 extra
  • Saturday delivery: $30.00
  • Disbursement of duties and taxes charged to the shipper (DTP): $10.00 OR 5% of the prepaid value to the shipper
  • Fuel Surcharge: All our rates are subject to a fuel surcharge.
  • A review will be done monthly.
  • Invoice rebilling: $10.00

Extended Area Surcharge:

  • Shipments within Canada: The greater of $20 or $0.40 per pound (0.5 kg)
  • International Shipments: Greater of $30 or $0.40 per pound (0.5 kg)
  • Repackaging:
  • A $10.00 fee will be charged to repackage a package deemed inoperable.

Insurance:

  • Additional insurance can be purchased from us in section 3 of our SHIPPING/QUOTE PAGE.
  • Shipments to Canada, the United States, and international destinations: Minimum charge: $3.50 or $3.50 per $100 of value.

Oversized package:

  • Length over 152 cm (60 in): $15 surcharge.
  • Maximum length: 270 cm (108 in)
  • Length over 270 cm (108 in): Minimum $50 surcharge.
  • Maximum weight: 68 kg (150 lbs) per piece: Minimum surcharge of $50.
  • Waist size: Length + (2 x width) + (2 x height)
  • Packages with two sides exceeding 30 inches (76 cm): $15 surcharge.
  • Length over 130 inches (330 cm): $50 surcharge.
  • Maximum waist size: 165 inches (419 cm). UPS ONLY/130″ on most carriers.
  • Waist circumference greater than 165 in (419 cm): $50 minimum surcharge.

Package Restrictions:

  • FedEx Express packages can only be used for Express shipping, except for FedEx 10kg and 25kg boxes. If these boxes are used, the “GMX WORLDWIDE XPRESS discount will NOT apply.

Volumetric weight:

  • The chargeable weight is either the gross weight or the volumetric weight, whichever is greater.
  • The volumetric weight is calculated using the following formulas:
  • Length x Width x Height (in.) = divided by 139 = volumetric weight in pounds.
  • Length x Width x Height (cm) = divided by 5000 = volumetric weight in kilograms.

Taxes:

  • GST applicable to all shipments in Canada
  • PST applicable to all shipments in Quebec
  • HST applicable on shipments for certain provinces
